Las Vegas Personal Injury Attorney

Automobile accidents from driver fatigue have the potential to cause serious harm and this danger can be increased when a semi-truck is involved. Federal hours of operation laws limit the amount of time a truck driver can be on the road, however these regulations are not always followed. Commercial truck drivers are often under pressure to adhere to strict timelines and may operate their vehicles longer than legally permitted. According to the Insurance Institute for Highway Safety, many commercial truck drivers surveyed admitted to violating regulations by working longer than allowed.

If you have been in an accident involving a semi-truck, it is vital to seek legal representation from our Las Vegas personal injury attorney as soon as possible. The legal team at Eric Roy Law Firm is highly knowledgeable on the specific regulations and laws relating to trucking accidents and can help you to maximize your potential compensation. Federal Hours of Service Laws

The number of hours a truck driver is allowed to operate their vehicle is tightly regulated by the Federal Motor Carrier Safety Administration (FMCSA). One of the main reasons that these laws are in place is to prevent accidents due to tired and sleepy drivers. When drivers do not follow federal hours of service regulations, and an accident occurs due to driver fatigue, they can be liable for resulting injuries and damages.

Drivers who are transporting property:

  • Cannot operate a vehicle for more than 11 hours after 10 consecutive hours off the road
  • Cannot drive past the 14th consecutive hour after returning from 10 consecutive hours off duty
  • May only begin a shift if less than 8 hours have passed since their last off duty period or sleeper berth.
  • Are limited to driving 60 hours in 7 days or 70 hours in 8 days. This period restarts after 34 consecutive hours off duty.

Proving that driver fatigue was a factor in your crash can be difficult, however, there are several tools which can help to support your case. Increasingly, trucking companies have been required to install electronic on-board recorders (EONB) or electronic logging devices (ELD) on their vehicles which can monitor data such as hours of service. Our truck accidents attorney can help you acquire this information and determine the likelihood that negligence was a contributing factor in your accident.
